These Terms of Service (“Terms”) govern your access to and use of all services provided by Mynymbox LLC (“Mynymbox”, “we”, “us”, “our”).
We reserve the right to update or modify these terms at any time without prior notice. Continued use of our services after any changes to the Terms of Service will constitute acceptance of those changes.
By ordering, accessing, or using the Services, you agree to these Terms of Service (ToS) and our Acceptable Use Policy which is part of these ToS and appears below under the heading ACCEPTABLE USE POLICY.
ACCOUNT REGISTRATION
You need a working email address to register an account with us, and you agree that we may send billing, security, operational, and abuse notices to that address. It is your responsibility to keep your email address up to date. We don't need a personal email address from you, we also accept email aliases from 3rd party services.
SERVICE SCOPE AND SUPPORT
Unless we agree otherwise in writing, services are unmanaged. Most support tickets are generally answered within 24 hours.
BILLING AND RENEWALS
All services are billed in advance unless stated otherwise.
We accept the cryptocurrencies Bitcoin, Lightning, Monero and Litecoin with our self hosted payment gateway without any third party. For all other altcoins we use the swap service Trocador.app.
Renewal invoices are issued 10 days before the service due date. If an invoice becomes more than 2 days overdue, we may suspend the related service(s). If an invoice remains overdue for 4 days, we will terminate the related service(s). Upon termination, all data will be deleted from our systems and will not be recoverable.
CHARGEBACKS AND PAYMENT DISPUTES
If a PayPal or credit card chargeback or dispute is received for a transaction on an account, that account and any related accounts will be immediately closed and all servers and data associated with the account(s) will be deleted from our system.
REFUND POLICY
Shared Hosting and Virtual Private Serves (VPS) purchases may be refunded if requested within 3 days of the initial purchase. Approved refunds are issued in the same cryptocurrency used for the original payment, and network fees may apply.
Dedicated servers, domain registrations, domain transfers, domain renewals, additional IP addresses, and third-party fees are non-refundable. We may refuse refunds where there is fraud, abuse, or a violation of these Terms or our Abuse Policy.
BACKUPS AND DATA RESPONSIBILITY
Unless your plan explicitly includes backups, you are responsible for your own backups. If backups are offered, they are not guaranteed and may be incomplete or not restorable. You accept that data loss, corruption, and accidental deletion can occur, and you are responsible for protecting your data.
ACCEPTABLE USE POLICY
You may use the Services only for lawful purposes and in a way that does not harm our network, other customers, or third parties. You are responsible for all activity under your account, including activity by anyone you allow to access the Services.
You may not store, host, transmit, distribute, or make available illegal content. You may not use the Services for child sexual abuse material (CSAM), exploitation, or content that facilitates harm to minors. You may not use the Services for deception or fraud, including phishing, credential theft, or impersonation intended to mislead. You may not develop, distribute, host, or control malware, ransomware, trojans, spyware, or botnets using the Services.
You may not attempt unauthorized access, scan or exploit systems without permission, or participate in denial-of-service attacks. You may not operate illegal marketplaces or facilitate illegal transactions using the Services.
Anti-Spam policy. You may not use the Services to send spam or unsolicited bulk messages, or to operate infrastructure primarily intended to enable spam. This includes sending unsolicited email, running open relays or open proxies for mail delivery, harvesting email addresses, using purchased lists without clear opt-in consent, and using deceptive headers, misleading subject lines, or spoofed sender information. If we receive spam complaints or detect spam activity, we may rate-limit, block, suspend, or terminate the affected Service(s) and may require you to prove opt-in consent and list source before restoring service.
You may not disrupt, degrade, or interfere with our systems or other customers, and you may not bypass quotas, access controls, security measures, or rate limits. You may not infringe intellectual property rights, including copyright and trademarks, and you may not violate privacy rights, including doxxing or unauthorized disclosure of personal data.
Resource abuse is not allowed on Shared Hosting and VPS. You may not run workloads that repeatedly or continuously consume excessive CPU, memory, disk I/O, network, or process counts in a way that impacts stability or other customers, including sustained near-100% CPU use. If resource abuse occurs, we may throttle, limit, suspend, or require you to upgrade or migrate to a more suitable service.
We forward abuse or infringement notices to your account email in form of an support ticket and may require you to remove or disable the reported material. You must respond within 48 hours and take corrective action. If you do not, or if the issue is severe, we may investigate and take action we consider appropriate, including removing or disabling content, throttling, suspending or terminating Services, preserving relevant logs or content, and reporting illegal activity where required by law.
DOMAIN NAME REGISTRATIONS
This section applies if you purchase, transfer, renew, or manage domains through Mynymbox.
Domains registered through our system are registered in the name of Mynymbox LLC on your behalf, and Mynymbox does not own these domains. You keep the right to sell, transfer, assign, control, and renew your domains, and you are responsible for any monetary or legal claims related to them.
We do not guarantee that a domain shown as available will be registered successfully. Domain services are provided without warranty to the maximum extent permitted by law.
Domain prices may change at any time. Our search may not detect premium domains and may display standard pricing. If a domain is actually premium, we may cancel the order and issue account credit, or we may apply the amount paid toward the premium price if you choose to proceed and any additional funds are received.
We will not process, and we may cancel, any domain used or intended for phishing, copyright or trademark violations, or other breaches of these Terms or the AUP. In such cases, any refund is account credit only. If a domain is already registered and later used for phishing or similar abuse, we may suspend it.
ORDER PROCESSING
Shared Hosting and Virtual Private Servers (VPS) are generally set up automatically after successful payment. Dedicated servers may take up to 48 hours to provision. Domain orders are screened and processed manually (for reasons including fraud protection) and are usually handled within 24 hours. Unpaid orders older than 24 hours may be removed from our system.
DISCLAIMERS; LIMITATION OF LIABILITY; INDEMNITY
The Services are provided “as is” and “as available”, without warranties of any kind, express or implied, and your use of the Services is at your sole risk. Mynymbox disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranties as to the availability, quality, quantity, or content of the Services, your website, or any results you may obtain from using the Services. Mynymbox does not guarantee that the Services will be uninterrupted, secure, or error-free, or that any content, information, software, or other material accessible through the Services will be free of viruses, worms, trojan horses, or other harmful components, and we make no representations regarding traffic, patronage, or business outcomes for any website. Mynymbox will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, or data, even if we were advised of the possibility, and Mynymbox’s total liability is limited to the amount you paid for services in the preceding 3 months. You will defend, indemnify, and hold harmless Mynymbox and its owners, personnel, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Services, your breach of these Terms or the AUP, your violation of law, or any allegation that your content or use infringes or misappropriates a third party’s rights.
GOVERNING LAW
These terms are governed by the laws of the State of Wyoming, United States. Any disputes shall be resolved in the courts of Wyoming.
FORCE MAJEURE
We are not liable for failure or delay caused by events beyond our reasonable control, including provider failures, power or network failures, natural disasters, civil unrest, or government actions.
SEVERABILITY, WAIVER, ASSIGNMENT, AND ENTIRE AGREEMENT
If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent, and we may assign them as part of a merger, acquisition, reorganization, or sale of assets.
