Terms of Service (TOS)
The following terms and conditions (these “Terms”) govern the provision by ITNetConsult Inc (“Mynymbox”) of the services and/or products (referred collectively herein as (“Services and Products”) described on the Server Order Form, the Service Level Agreement and Service Exhibit attached hereto (collectively the “Service Descriptions”) and defined in any of the Company’s product support listing, to the customer (“Customer”) identified on the Service Descriptions. The Service Descriptions, these Terms of Service and the attachments and any addenda hereto, executed with respect to the Services and Products, are referred to herein, collectively, as this "Agreement." Mynymbox reserves the right to change and update this document as needs change or arise.
- Account Setup / Registration. It is Customers responsibility to ensure that your provided email address is valid and up to date at all times. If there is ever an abuse issue or we need to contact the Customer, the provided email address from the Customer will be used for this purpose. Failure to do so constitutes a breach of the TOS, which may result in immediate termination of your account on our Service.
The Customer is responsible to keep passwords safe and not disclosure it to any third parties. The Customer must notify us immediately upon becoming aware of any breach of security or unauthorized use of the Customer account. - Jurisdiction and Jurisdictional Disputes, Legal Responsibilities. The parties expressly recognize that, where Mynymbox is acting solely as Customer’s Host, Mynymbox is not engaged in, and is not actively soliciting, interstate or international commerce for said Customer. Where Mynymbox is a named party to any type of dispute or litigation involving any acts by Customer that affect out-of-state persons or entities, Customer agrees that it shall indemnify, hold Mynymbox harmless, defend Mynymbox exhaustively (including all legal cost(s), and challenge the jurisdiction of out of state authorities over Mynymbox). Any legal issue must be resolved by the laws in the Seychelles.
- Availability and Backups. Mynymbox shall store Customer’s web sites, files, email and databases on their servers. The parties expressly recognize that internet servers and links are susceptible to crashes, down time, vulnerabilities and that from time to time Mynymbox may need to preform maintenance on their services. Customers with unmanaged services are to manage their own backups at their own expense. Mynymbox is not responsible for data that you may have lost due to said crashes, down time or vulnerabilities. In addition Mynymbox will not support illegal activities by providing you with a backup if your Web Hosting contains any of the materials found under the Abuse section of this document. Due to the nature of computer hardware, Mynymbox is not liable for any data loss occurred.
- Maintenance. Mynymbox may temporarily suspend all service for the purpose of repair, maintenance or improvement of any of its systems, or whatever it deems necessary to maintain adequate services. However, Mynymbox shall provide prior notice within 24 hours for all scheduled maintenance. Emergency maintenance may be carried out at any time, with or without notification. Invalid rDNS records may be removed at our sole discretion. For all customers, efforts must be made to ensure that their service do not get listed, banned or blocked, by any firewalls or blacklists. Mynymbox will not be able to provide a replacement IP address for actions caused by customer's negligence.
- Bandwidth. The Customer are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package. Should the account of the Customer pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.
- Security. The parties expressly recognize that it is impossible to maintain flawless security, therefore the customer is solely responsible for properly securing their hosting service provided by Mynymbox including changing initial passwords and making any security adjustments and patches over time. Customer is solely responsible for any damage caused by such unauthorized access, and Customer indemnifies and holds Mynymbox harmless for any compromise of Customer’s security that resulted from their own actions, the actions of Mynymbox or the actions of any third party.
- Refunds. All sales are final and no refund will be issued.
- Copyright & Abuse. Mynymbox is not responsible for copyright infringements caused by what the Customer hosted on Mynymbox's servers. Mynymbox has 0 tollerance for illegal activities. Hosting child pornography, terrorist propaganda, but not limited to, is COMPLETELY forbidden and any client found to be doing so will be cancelled immediately upon discovery.
- Payment Information. Mynymbox accepts cryptocurrencies like Bitcoin, Lightning, Litecoin and Monero directly with our self hosted BTCPayServer and other cryptos via TrocadorApp. All services are prepaid. We will send you an invoice for your service renewal 10 days before its renewal date. Any Shared Hosting or VPS hosting account more than 5 days overdue will be suspended. Any account with an overdue more than 15 days will simply be terminated. All data will be removed. Mynymbox will not activate new orders or activate new packages for customers who have an outstanding balance with Mynymbox. For a new order to be setup or a new package to be activated, you must have a balance of 0.00 EUR, unless otherwise stated by Mynymbox in writing.
- Shared Hosting, Email services, Mynymbox VPS Servers. If Mynymbox determine that a customer's account is utilizing an unacceptable amount of system resources, we may temporarily deactivate the account in question. If we deem it necessary, an eviction notice may be sent to the customer of an offending account providing them with five (5) days in which to locate a new provider.This only occurs in extreme cases.
Customers are not permitted to run programs in the background on shared hosting servers. This tends to use a lot of system resources, and can impair service to other customers on that server.
The Customer is ultimately responsible for the backup of their information.
Mynymbox is not responsible for any kind of data loss.
The Mail service is not to be used to send mass mailings (regardless if it's SPAM or not). Using SPAM to advertise a site hosted on Mynymbox also constitutes as a violation of this provision.
If the customer loose his account login and could not be verified to regain access to his account the account will be closed for security reasons. - Domain Name Services. Customer domain names are registered under the name of ITNetConsult Inc, on behalf of said Customer. Mynymbox shall not have the actual ownership of the domains registered through our system. Customer retains the right to sell, transfer, assign, control, renew each domain name registration upon expiration, being as well responsible to resolve any and all monetary or other legal claims that arise in connection with Customer’s domain. We do not guarantee that you will obtain the domain name applied for, even if your inquiry has indicated that the domain name is available at the time of submission. Mynymbox provides no warranty with regard to the offered services. Domain registration, renew or transfer fees may change at any time.
- Country restrictions. Citizens and companies incorporated within Seychelles are prohibited from using Mynymbox.
- Service Provisioning. Shared Hosting and VPS Servers are configured to be setup automatically after a successful payment. Dedicated Servers setups can take up to 48 hours.
Domain Names orders are screened and processed manually within 24 hours. There is no auto-completion process and require manual action on our behalf to complete for some reasons like fraud protection.
Placed but unpaid orders for more than 24 hours may be deleted from our system. - Support. All services of Mynymbox are unmanaged unless otherwise specified on the product information. Support tickets are usually answered within 24 hours. Sales related tickets have a lower priority and therefore the answer can take longer. We always prioritize existing customers and services over incoming tickets.
- For VPS Servers. Mynymbox resells services from a selection of providers. You also must abide by the terms and conditions imposed by our hosts:
- Final note. Failure by either Mynymbox or Customer to enforce any of the provisions of this Agreement or any rights with respect hereto or the failure to exercise any option provided hereunder shall in no way be considered to be waiver of such provisions, rights or options, or to in any way affect the validity of this Agreement. If one or more of the provisions contained in this Agreement are found to be invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not be affected. This Agreement may be executed in any number of counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
